BUILDER REFERRAL TERMS AND CONDITIONS
1. The Promotion
1.1 By entering, or otherwise participating in, the Wedge Rd. Skye Builder Referral Promotion (“Promotion”) you are deemed to have read and accepted these Terms and Conditions. If you do not agree with these Terms and Conditions, you should not enter or participate in the Promotion.
1.2 The promoter is YourLand Realty Pty Ltd ACN 635 068 932 of Suite 1.04, Level 1, 68 Clarke Street, Southbank VIC 3006 (“Promoter”).
1.3 The Promotion commences at 9:00am AEST on 1 June 2024 and closes on 11.59pm AEST on 18 December 2024 (“Promotion Period”).
1.4 The Promoter reserves the right to vary the terms of, or cancel, the Promotion at any time without liability to any participant or other person, subject to applicable laws.
2. Conditions of Entry
2.1 Employees, directors and other representatives of the Promoter are ineligible.
2.2 Incomplete entries may be deemed to be invalid at the discretion of the Promoter.
2.3 There is a limit of one (1) entry per person, per purchase.
2.4 The Promoter is not responsible or liable for any attempted entries that are not received for any reason, illegible entries, incorrect transcription of entry information, technical failures of any kind in relation to entry to the Promotion, the unavailability of any service in relation to entry to the Promotion, third party interference and technical or human error in relation to the administration of the Promotion. Late entries will not be accepted.
3. Eligibility
3.1 To enter the Promotion:
(a) you must complete in full (including your details and the individual’s details that you are referring (“Referee”)) and deliver the attached referral application
form (“Application Form”) to the Wedge Rd. Skye Sales Team by way of email to hello@wedgerd.com.au prior to the end of the Promotion Period; and
(b) the Referee must:
(i) have signed a contract of sale for a block of land in Stage 1 or Stage 2 within Wedge Rd. Skye Estate (in the form to be provided by the Promoter) and have that contract become unconditional prior to the end of the Promotion Period (“Referee Contract of Sale”);
(ii) have completed the cooling off period under the Referee Contract of Sale prior to the end of the Promotion;
(iii) comply with all terms and conditions set out in the Referee Contract of Sale at all times prior to settlement;
(iv) complete settlement in accordance with the terms and conditions set out in the Referee Contract of Sale; and
(v) not already exist on the Wedge Rd. Skye database at the time of the referral.
(c) you must be an authorised representative of a registered builder within the State of Victoria at the time of making the referral.
3.2 By signing and delivering the Application Form in accordance with clause 3.1(a) of these Terms and Conditions, you and the Referee agree to these Terms and Conditions.
3.3 If more than one individual is listed as the purchaser in the Contract of Sale, this is deemed to be one entry for the purpose of the Promotion.
4. Rebate
4.1 The Rebate consists of a one off payment in the form of a Visa Gift Card for the value of ten thousand dollars (AUD $10,000.00) inclusive of GST (“Rebate”).
4.2 The Promoter will arrange for the Rebate to be delivered to you within 60 days of settlement of the Referee Contract of Sale.
4.3 The Rebate is not exchangeable for any other goods or services.
4.4 The issuer of the Visa Gift Cards has its own terms and conditions governing the use, expiry, and transferability of the gift card. The Promoter makes no warranty as to the terms contained in the issuer’s policies. Participants must make their own enquiries with the issuer of a gift card.
5. General
5.1 To the extent permitted by law, the Promoter excludes all liability for any personal injury, loss or damage in any way arising as a result of entry or participation in the Promotion or receiving the Rebate or any aspect of the Promotion or the Rebate.
5.2 The Rebate is subject to availability. The Promoter reserves the right to amend, withdraw or substitute the Rebate or any component of the Rebate in the event of any unforeseen circumstances outside its reasonable control.
5.3 The Promoter expressly denies and excludes all representations about the Promotion or the Rebate except as set out in these Terms and Conditions.
5.4 The Promoter’s decision is final and no correspondence will be entered into.
5.5 The Promoter is not responsible for any tax implications that may arise from receiving the Rebate. Independent financial advice should be sought in relation to receipt of the Rebate.
5.6 The Promoter reserves the right to verify the validity of entries and reserves the right to disqualify any person who is in breach of these Terms and Conditions or has engaged in any improper conduct in connection with the Promotion in its absolute discretion.
5.7 The Promoter will collect personal information of both you and the Referee to conduct the Promotion. The Promoter will conduct the promotion in accordance with the Promoter’s Privacy Policy which is available at https://wedgerd.com.au/disclaimer/
5.8 Entrants consent to the Promoter using their name, image and/or voice, including a photograph or recording, in any media for an unlimited period without remuneration for the purpose of promoting the Promotion, future promotions and/or the Promoter.
5.9 The Promotion shall be governed by the laws of Victoria, Australia.
YOURLAND “WEDGE ROAD SETTLEMENT DISCOUNT” PROMOTION
TERMS AND CONDITIONS
- The Promotion
- These terms and conditions (Terms and Conditions) apply to a promotion being offered by the Promoter. The Promoter is Yourland Management Pty Ltd ACN 151 294 852 (Promoter).
- By participating in the Yourland “Wedge Road Settlement Discount” Promotion (Promotion), you are deemed to have read and accepted these Terms and Conditions. If you do not agree with these Terms and Conditions, you cannot participate in the Promotion.
- The Promotion commences on 8 June 2024 at 9:00am AEST and closes on 18 December 2024 at 5:00pm AEST (Promotional Period).
- Eligibility
- To participate in the Promotion, you must:
- sign a contract of sale of land (in the form to be provided by the Promoter) for a select lot of land in Stage 1 of the Wedge Road Estate (Contract of Sale) and pay the full deposit required under the Contract of Sale during the Promotion Period;
- comply with all terms and conditions set out in the Contract of Sale at all times prior to settlement; and
- complete settlement in accordance with the terms and conditions set out in the Contract of Sale.
- Participation in the Promotion is open to individual and entity participants, participation is only available to individuals who are over 18 years of age and residents of Australia.
- Unless otherwise agreed by the Promoter, a participant is not eligible to receive the Promotion Benefit on more than one Contract of Sale and the Promotion cannot be used in conjunction with any other offer or promotion being offered by the Promoter.
- Promotion Benefit
- If you meet the eligibility requirements set out in these Terms and Conditions, the Promoter shall provide you with a discount on the purchase price at settlement of the Contract of Sale of $40,000.00 (Promotion Benefit).
- The Promotion Benefit will be applied at settlement and is not redeemable for cash.
- The Promotion Benefit will at all times remain subject to these Terms and Conditions.
- The Promotion Benefit will be included in the terms of the Contract of Sale.
- The Promotion Benefit is only available on select lots as determined by the Promotor at its sole discretion.
- Despite any term to the contrary, a participant who does not do all things reasonably necessary to effect settlement of the Contract of Sale before the original settlement date as defined in the Contract of Sale, will not be eligible to receive a Promotion Benefit.
- Despite any term to the contrary, a participant who is granted an extension to the original settlement date as defined in the Contract of Sale, will not be eligible to receive a Promotion Benefit unless otherwise expressly agreed by the Promoter in writing.
- General
- To the extent permitted by law, the Promoter excludes all liability for any personal injury, loss or damage in any way arising as a result of receiving the Promotion Benefit or any aspect of the Promotion Benefit.
- The Promoter expressly denies and excludes all representations about the Promotion, except as set out in these Terms and Conditions.
- The Promoter reserves the right to vary the terms of, or cancel, the Promotion at any time without liability to any participant or other person, subject to applicable laws. The eligibility of participants to participate in the promotion is solely within the discretion of the Promoter.
